Welcome to Swan Labs. These Terms of Service ("Terms") govern your use of our website, applications, and services (collectively, the "Services") operated bySwan Labs("Swan Labs", "we", "us", "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our Services.

1. Use of Services

1.1 Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you represent that you have your parent or guardian's permission to use our Services.

1.2 Account Registration

Some features require an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the security of your account and password. You must notify us immediately of any unauthorised use.

1.3 Acceptable Use

You agree not to:

  • Use our Services for any illegal purpose
  • Attempt to gain unauthorised access to our systems
  • Interfere with or disrupt our Services
  • Upload malicious code or content
  • Impersonate others or misrepresent your affiliation
  • Use our Services to harass, abuse, or harm others
  • Circumvent any usage limits or restrictions
  • Resell or redistribute our Services without permission

2. AI Services

2.1 Nature of AI

Our AI services (including Swan Chat) use large language models to generate responses. AI-generated content:

  • May not always be accurate, complete, or current
  • Should not be relied upon as professional advice (legal, medical, financial, etc.)
  • May contain errors or hallucinations
  • Is provided for informational and assistance purposes only

2.2 Your Responsibility

You are responsible for verifying any AI-generated information before acting on it. For consequential decisions (health, legal, financial), always consult qualified professionals.

2.3 Content Restrictions

You agree not to use our AI services to generate:

  • Content that is illegal, harmful, or violates others' rights
  • Misleading or deceptive content presented as factual
  • Content that promotes violence or discrimination
  • Sexually explicit content involving minors
  • Malware, spam, or phishing content

3. Subscriptions and Payments

3.1 Paid Plans

Some features require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the renewal date.

3.2 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access to paid features until the end of your current billing period.

3.3 Refunds

We generally do not provide refunds. However, we may consider refund requests on a case-by-case basis. Contact support@swanlabs.com.au for assistance.

4. WA Resident Program

The WA Resident program offers benefits to verified Western Australian residents. By participating, you confirm that you genuinely reside in Western Australia. We reserve the right to verify your residency and revoke benefits if verification fails or false information is provided.

5. Intellectual Property

5.1 Our Content

Our Services, including software, design, text, and graphics, are owned by Swan Labs and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

5.2 Your Content

You retain ownership of content you create using our Services. By using our Services, you grant us a limited licence to process your content as necessary to provide the Services.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Our Services are provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months (or $100 AUD if you haven't paid anything)

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

7. Indemnification

You agree to indemnify and hold harmless Swan Labs and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Services or violation of these Terms.

8. Termination

We may suspend or terminate your access to our Services at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your right to use our Services ceases immediately.

9. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of our Services after changes become effective constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes shall be resolved in the courts of Western Australia.
